Introduction
Parties

These Terms form a legally binding agreement between you (the “Client”) and GiftedThinkers. If you are a parent or guardian entering into these Terms on behalf of a minor (the “Student”), then references to “you” or “Client” also apply to the Student.

Registration and Account
Registration Requirements

You may browse most parts of our Website without registering. However, to access paid tutoring sessions and certain features, you must complete our onboarding process or sign up for an account. The information you provide must be accurate, complete, and current.

Account Security

You are responsible for maintaining the confidentiality of your login details. If you suspect any unauthorized use of your account, please notify us immediately.

Services Provided
Scope of Tutoring

GiftedThinkers will provide online tutoring sessions in subjects selected by the Client (e.g., English, Mathematics, Science, Foreign Languages, 11+ exam preparation, etc.). Each session generally lasts 1 hour and is conducted online (e.g., via Microsoft Teams).

Student Conduct

(a) The Student is expected to behave respectfully toward the tutor.
(b) Disruptive or offensive behavior may lead to suspension or termination of Services.
(c) The Student should have all necessary materials and a reliable internet connection.

Rescheduling and Missed Sessions

If the Client or Student must cancel or reschedule an individual session, at least 24 hours’ notice is required. If notice is not provided within this timeframe or the Student does not attend, the full fee for that session may still be charged.

Subscription and Payment Terms
Rolling 12-Month Subscription

(a) Our tutoring program operates on a rolling 12-month subscription model.
(b) Even if you only need a few months of lessons, the rolling subscription ensures predictable, simplified billing for all Clients.

Monthly Fees and Payment Schedule

(a) You agree to pay a fixed monthly subscription fee. This fee typically covers approximately 46 sessions per year, factoring in up to 2 weeks of tutor holidays.
(b) Payments are due monthly in advance.
(c) We use GoCardless direct debit as our payment provider. By enrolling, you authorize us to collect monthly payments via direct debit from your chosen bank account.

Cancellation Policy

(a) You may cancel your subscription at any time by giving us 30 days’ written notice (via email).
(b) Your subscription and associated billing will continue through the end of the 30-day notice period.
(c) After cancellation, you will no longer have access to our tutoring sessions unless you re-subscribe.

Confidentiality and Data Protection
Confidentiality

We will treat all personal information (including names, contact details, and academic records) as confidential and only disclose such information when required by law or with your explicit consent.

Data Protection and GDPR

(a) We collect personal information solely for the purpose of delivering our tutoring Services.
(b) We keep your data secure and do not share it with third parties unless it is required for the provision of Services (e.g., an online meeting platform) or required by law.
(c) You can request a copy, correction, or deletion of your personal data at any time.

Tutoring outcomes can vary based on the Student’s effort, attendance, and other factors. We do not guarantee specific academic results or grade improvements.

(a) To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential loss or damage arising from your use of the Website or our Services.
(b) Nothing in these Terms will exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
